| The first year of law
school is all about the study of specific rules -- Rule 23, the
Felony-Murder Rule, the Mailbox Rule, etc. Rarely does any class
spend much time pondering the general properties of rules. This
seminar does just that. It asks four questions about rules in
general:
(1) What is it about a precedent that binds
future courts?
(2) What makes a norm law?
(3) What is the nature of a legal right? and
(4) What is it that gives law its authority?
Those who need clear-cut answers and black-letter law to hold on
to will not be comfortable. Class presentations and a paper will
be required. |
