An investigation of, among other
topics: What is law? Law versus custom; discretion; morality;
policy. Law versus "common sense;" logic; reason. Does
law need a lawgiver? Sources; legitimacy; law as command; as
expectation; as hope. Must law be enforced? Dead letter
statutes; international law. Why should wrongs be righted?
Emphasis will be placed upon distinctively American
preoccupations, such as "mechanical jurisprudence" and
the revolt against rules; the philosophic underpinnings of the
Restatements and other codes; legal realism; "neutral
principles;" Chicagoism.
